Certain states require that prior to the construction of an Ambulatory Surgery Center, renovations, or modernization, a Certificate-of-Need (‘CON’) authorization is required. The requirements for each state may be different based on what constitutes the requirements for a CON, such as medical equipment purchases, establishment of new medical/expanded service or a reduction or termination of services, or certain monetary thresholds per capital amount of project. In most instances, the CON process can be cumbersome, with lengthy applications, requirements for supporting documentation, feasibility studies, public hearings, and the final submission to be presented to a board for approval.
